Zampini Studio Terms of Service

Zampini’s Studio is operated by Zampini LLC, 14977 Topgallant St., Corpus Christi, TX 78418. These terms apply to zampinismusic.com and our related event music and optional media services. Version zampini-2026-10-02-v1 takes effect when posted and accepted; it does not retroactively change completed transactions.

1 Agreement and eligibility

By selecting the agreement checkbox and submitting a request or purchase, you agree to these Terms of Service and the Payment and Refund Policy. Our Privacy Policy explains our data practices. Voice, image, saved-recording, and promotional permissions are separate. If you do not agree, do not submit a request or purchase. You must be at least 18 years old and legally able to enter this agreement. Do not submit recordings or images of minors. Event attendance alone does not constitute agreement or consent to recording.

2 How the service works

You provide a theme and available music choices. Artificial intelligence creates music, lyrics, or optional visual content. Results can contain mistakes, unexpected words, inaccurate likenesses, or changes in style, tempo, and pronunciation. We do not guarantee an exact voice match, a particular artistic result, uniqueness, copyright protection, or freedom from third-party claims. Descriptions of features and purchased deliverables still apply.

The DJ controls review, playback, queue order, and event suitability. Guests do not receive advance audio previews; the intended first listen is public playback by the DJ. Generation or submission alone does not guarantee playback. Any purchased priority service is governed by its checkout description and our refund policy. Connectivity, provider availability, and event conditions can affect timing.

3 Your submissions and permitted use

Submit only material you have the right to use for the requested service. Do not provide private information about others, copyrighted lyrics or recordings without authorization, or content that is unlawful, threatening, defamatory, discriminatory, sexually exploitative, or intended to deceive. Do not request impersonation, a false endorsement, or a clone of another person’s voice. Our creative-input rule prohibits musician names, band names, and existing popular song titles as generation instructions. Describe musical characteristics instead.

Do not bypass access controls, misuse event codes, interfere with the service, or access another guest’s saved recording. Each adult appearing in optional submitted media must give the required personal consent. A group organizer cannot consent to another person’s voice cloning merely by submitting a group request.

4 Permission to process submissions

You retain any rights you already hold in your original submissions. You grant Zampini LLC a nonexclusive, worldwide, royalty-free permission to receive, store, reproduce, adapt, and process them to produce your requested content, review it, present it at your selected event, operate the requested archive or saved-recording feature, and resolve support issues. We may authorize necessary service providers to perform these tasks only within the permissions and legal limits applicable to the data. This permission does not authorize unrelated advertising, sale of your voice or biometric identifiers, or creation of new songs using your saved voice without your request.

Permission ends when the relevant service purpose ends, subject to lawful recordkeeping, resolving disputes, and completing deletion from active systems and backups. Voice and image permissions also follow their separate notices. An event performance already heard cannot be recalled. Keeping a completed song does not authorize retaining its source voice model indefinitely.

5 Generated content and downloads

Payment purchases only the service or deliverable identified at checkout. It does not by itself transfer copyright, grant exclusive rights, or permit commercial distribution. Guests have no automatic right to download songs, obtain source recordings, or receive a USB copy. A DJ-authorized export or separately purchased deliverable may be provided where offered and where provider rights allow it.

For a copy we expressly authorize you to receive, we grant personal, noncommercial use to the extent we have the right to do so. Commercial release, resale, synchronization, licensing, or distribution requires separate written permission and clearance of any other applicable rights. Similar results may be generated for others. Zampini LLC retains its rights in the app, branding, software, and original business materials.

6 Moderation and access

We may reject or remove content, decline playback, restrict a feature, or suspend access for a violation, a credible rights or safety concern, or operational necessity. We may notify you through available service channels. Moderation does not guarantee that every issue will be detected. Paid services that are not provided remain subject to our refund policy. Contact us if you believe a restriction is mistaken.

7 Service limitations

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND AI OUTPUT ARE PROVIDED AS IS AND AS AVAILABLE. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THESE DISCLAIMERS DO NOT OVERRIDE EXPRESS PURCHASE COMMITMENTS, REFUND OBLIGATIONS, OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

8 Limits of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ZAMPINI LLC IS NOT LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE SERVICE, INCLUDING LOST PROFITS. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE SERVICE IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID ZAMPINI LLC FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, liability that cannot legally be limited, or amounts refundable under our Payment and Refund Policy. Nothing waives nonwaivable consumer, privacy, or other statutory rights.

9 Responsibility for third party claims

To the extent permitted by law, you agree to reimburse Zampini LLC for reasonable, documented losses, judgments, and legal expenses arising from a third-party claim caused by your unlawful submission, infringement of another person’s rights, or intentional misuse of the service. This obligation applies only to the extent caused by your conduct, not by Zampini LLC’s negligence or misconduct. We will provide reasonably prompt notice and a reasonable opportunity to participate in the defense. Neither party may settle a claim imposing an admission or nonmonetary obligation on the other without that party’s consent.

10 Disputes and general terms

Texas law governs, excluding conflict-of-law rules, except where mandatory law provides otherwise. Subject to mandatory consumer protections and jurisdiction requirements, disputes may be brought in the state courts serving Nueces County, Texas, or the applicable federal court serving Corpus Christi. This agreement does not require arbitration or waive the right to bring an otherwise available small-claims case.

Please contact us first so we can try to resolve concerns, but doing so is not a prerequisite to exercising legal rights and does not shorten any legal deadline. If a provision is unenforceable, the remaining provisions continue where legally possible. These terms, the refund policy, applicable feature consents, and any agreed order describe our agreement for the service. A signed event agreement controls conflicting event-specific business terms. Material changes apply prospectively after notice and any legally required acceptance or consent.
